Lebanon man found with open Modelo beers during traffic stop

28-year-old Kilbert Josue Garcia was charged with DUI and driving on a revoked license when he was pulled over for driving erratically on Sparta Pike and was found with open Modelo beers in the floorboard.

On September 25th, Lebanon Police Officer Allison Humes was dispatched to locate a possibly impaired driver. Officer Humes located and followed the car on Sparta Pike and noticed it was crossing the white dotted line and the solid line. Officer Humes initiated a traffic stop and made contact with the driver, Kilbert Josue Garcia, and immediately noticed that he appeared to have watery, red eyes and observed a case of Modelo beer was on the floorboard.

There were several open containers in the vehicle, including an open container in the driver’s side door. Officer Humes also noticed the strong order of an intoxicant associated with alcoholic beverages on and about Garcia’s breath and person. Officer Humes offered several standardized field sobriety tests, all of which Garcia exhibited clues of impairment.

Kilbert Josue Garcia was arrested and charged with driving under the influence and driving on a revoked license. His bond was set at $3,500.
