Per the affidavit, Officer Deck noticed a strong smell of alcohol coming from Roberto. His eyes were reported to be red and watery, and he seemed unstable on his feet. Utilizing Roberto’s roommate as a translator, Officer Deck was informed that he drank two Modelo beers before driving. During a field sobriety test, Roberto showed signs of impairment, and two half-empty Modelo beer bottles were found in the vehicle that were still cold to the touch. A computer check revealed that Roberto did not have a driver’s license.

Roberto Cruz was arrested and charged with driving under the influence and driving without a license. He was later released on a $2,000 bond.
