According to the affidavit, Pignone claimed he ran out of gas and fell asleep. However, the deputy said he had over half of a tank of gas in the vehicle. Deputy Lanius advised Pignone exhibited signs of intoxication, such as red eyes, slurred speech, and unsteady feet, and performed poorly on several sobriety tests.

Jeffrey Pignone was arrested and charged with DUI. He was later released on a $1,500 bond.
