Deputy Smith noticed that Richard had slurred speech, bloodshot and watery eyes, unsteady on his feet and his breath smelled strongly of alcohol. While the deputy interviewed Richard, he noticed that his speech was incoherent. Deputy Smith deemed him intoxicated and that he could not care for his own safety.

Richard Moore was arrested and charged with public intoxication. He was later released on his own recognizance.
