20-year-old Cody Colter was charged with threatening his wife while they are going through a divorce and telling her that he wanted to pop her in the head and smash her head with a hammer, per report.
On May 13th, Officer Nicholson performed a welfare check at 236 University Avenue when he made contact with Joshua Darnell. Joshua told the officer that he has a recording of his sister, the victim, Allison Darnell, and the defendant, Cody Colter, who are going through a divorce, arguing. Allison came and spoke to the officer telling him that since they are getting a divorce that they have been arguing a lot over the course of the last few months. On the audio Officer Nicholson could hear Cody telling Allison “do you know how many mornings I wake up and want to pop you in the head and your bitch ass brother?”
Officer Nicholson was shown a text message from Cody on April 26, 2020, that read, “If I didn’t love you so much I would smash you in the head with a hammer.” Allison said that these statements did make her feel fear for her life. When Officer Nicholson spoke with Cody, Cody confirmed all the threats he made but stated that they all only took place on April 26th.
Cody Colter was arrested and charged with domestic assault. He was later released on his own recognizance.
