Mt. Juliet’s 27-year-old Evan Kelly Toby is charged with domestic assault of his wife. After a confrontation in their home which escalated to the point his wife attempted to call 911, Toby admits to slapping his wife’s hand and knocking the phone away, while threatening to harm himself if she called the police. He was ROR’d after a 12-hour domestic violence hold.

| On 08/26/2021 at approximately 10:18 pm I Ofc. Kamer was dispatched to a Domestic in Progress where an assault had occurred at 4018 Sleepy hollow Way. Upon my arrival, I made contact with the victim Erin Toby. She stated she and her husband Evan Toby had been arguing. She said while arguing he was yelling and cursing her then she told him she was going to call 911. Erin said he stated he would harm himself if she called and then she said when she had the phone to her ear calling, he slapped her hand knocking the phone to the ground. She said he continued to make threats of harming himself if the Police showed up. I then talked with the suspect Evan Toby, he said they had been arguing and when she went to make a call, he placed his hand over the phone. He said he did make comments about hurting his self, but it was due to the situation at hand and he did not want to hurt himself. This incident did occur in the city limits of Mt. Juliet Wilson, TN. I determined Evan Toby to be the primary aggressor. Mr. Evan Toby is being charged with T.C.A 39-13-111 Domestic Assault. |
