While talking with the man, later identified as Brad Hodges, the trooper noticed he had slurred speech, he was unsteady on his feet, and noticed an odor of alcohol on his breath and person. According to the affidavit, the trooper asked Brad if he had been drinking and Brad admitted to recently drinking Crown Royal whiskey. The trooper noted three field sobriety tests were administered and Brad showed signs of impairment on all of them.

Brad Hodges was arrested and charged with driving under the influence. He was later released on his own recognizance.
